Swilley said he, "would welcome a complete investigation by the Sheriff's Department, providing they would give us a fair investigation," and also would welcome investigations by the state attorney's office and a grand jury.

Swilley and Largo Public Relations Director William Doniel met with a Times reporter Thursday in Swilley's office to go over police reports, some written after newspaper accounts of the incident came out Wednesday, and to discuss the results of a retracing of the events that led up to the arrest. POLICE PERSONNEL went back to the scene with a stop watch and compiled a map showing the movements of the victim, and two police officers and three teenage members of the police auxiliary, who were to keep the woman under surveillance. The secondary investigation was an effort to prove that the victim, a 32-year-old Largo woman, was not out of the officers' sight long enough for the rape to have occurred. Swilley said that a total of 33 minutes elapsed between the time the woman came into the police station on her way to meet the caller until the arrest occurred. He said the victim was out of sight of the officers for a maximum of four minutes, a figure in conflict the "five to 15 minutes" cited by a sheriff's deputy who arrived at the scene shortly after the arrest.

It also conflicts with a report by one of the Largo policemen, Robert Hall, who says he saw a man inside the nearby Ridgecrest Elementary school complex after losing sight of the woman and, "I started to approach the school about five minutes later and advised officer (Bruce) Motts that I still hadn't seen her. In his report, Motts said "While on the playground I observed a black male near the northwest corner of the northwest building of (the) school. The subject was looking toward Taylor Park and motioning. Subject appeared to be motioning for someone in Taylor Park to come toward him," Motts said. HE SAID the officers lost visual contact with both the woman and the suspect, attempted to sight her again, then headed toward the school. When they neared, the woman screamed and the youth attempted to flee.

One of the policemen fired a shot into the ground and the youth was arrested. Motts quoted Deputy William Logan, who arrived on the scene shortly after the incident and who filed the original sheriff's department report, as asking what the situation was and when Motts explained they had captured a rape suspect, Logan said "You should have shot that nigg*r." The deputy was responding to a report of a gunshot in an unincoporated area. May 31., By VERNON KIRBY 01 Tht Time Stall LARGO Police Chief Ros-coe Swilley says a woman his men were keeping under surveillance while she met an obscene phone caller Sunday could not have been raped but Pinellas County Sheriff's Department- officials say, "There is no doubt in our mind" that the rape occurred. "My own interpretation I don't feel that this was a -rape. I feel that this woman went there she was mad at this individual I think she was (on) a personal vendetta against this man," Swilley said. SHERIFF'S Department Maj. Herman Vincent said, "There's not a question in our mind that she was pentrated and that's why he was charged with rape." Vincent said the charge against a 15-year-old boy was based on a report by the medical examiner.

Swilley indicated Thursday that the release by the Sheriff's Department of information about Largo's handling of the case was motivated by a squabble between officers from the two departments, intensified by two recent incidents that led to the firings of lic housing construction "is killing housing here." "Even if the program is restored in the next six months it will be hard to get the developers to come back here," he said, explaining the efforts put forth in getting developers in this area to build the 235 program houses originally.
