Justice Mary Lim, who retires this week, said the discoverability principle applies in Malaysia. She said that based on the peculiar facts of the case, time to sue would only start when Chong and Asmah discovered the negligence, not when it first occurred.Lim said Parliament has also recognised this position by legislating Section 6A of the Limitation Act which allows for a person to sue within three years from the discovery of negligence. The judge was part of a three-member panel comprising Chief Judge of Sabah and Sarawak Abdul Rahman Sebli and Justice Hasnah Hashim. The bench had, in an oral decision handed down previously, allowed the couple’s appeal from a Court of Appeal verdict which had earlier overturned the High Court ruling. The apex court ruling resolves uncertainty that had arisen from three conflicting Court of Appeal decisions. #medicolegal #mlsm

Two more children’s commissioners will be appointed to the Human Rights Commission of Malaysia (Suhakam), says law and institutional reform minister Azalina Othman Said.“The hope is to appoint three commissioners,” Azalina said at the International Symposium on the Empowerment of Children’s Commission here today.“So far, only Farah has been delegated and two more will be appointed,” she added, referring to Farah Nini Dusuki, a senior lecturer at Universiti Malaya’s law faculty who was appointed for a three-year term.“The objective before we appoint (another commissioner) is to see if Suhakam’s Office of the Children’s Commissioner (OCC) can play a more focused role because we are starting with more emphasis on the legal aspect,” Azalina said. She also said the need for the OCC to be established at the state level would be assessed as issues regarding children cannot be centralised. #medicolegal #speakingfortheunspoken #mlsm #childcommissioner #childrights

The father of an autistic schoolgirl who is believed to have taken her own life the day before she was due to have her first ever detention has paid tribute to his “daddy’s girl” at the inquest into her death.Caitlyn Scott-Lee, 16, was found dead at Wycombe Abbey, a private school in Buckinghamshire where she boarded, on 21 April last year. The inquest at Buckinghamshire coroner’s court heard she received the detention after alcohol was found in her locker. Painting a portrait of his talented daughter in an emotional statement, her father, Jonathan Scott-Lee, described how she was a “daddy’s girl”.“I took care of her, dressed her, cuddled her, fed her and soothed her,” he said. “As she grew as a toddler, there would be bitter-sweet moments where she would stand by the window of our home and cry as I left for my daily commute. Little did she know I would return each evening.“It is a myth that people with autism don’t have much emotion.”He said their feelings were “amplified” as they were “internal”, adding: “Caitlyn was so much more than autism, Wycombe Abbey and detention.” #speakingfortheunspoken #mentalhealth #vulnerablepopulation #mlsm

The country's healthcare system is among the best in the world but this is not reflected in the salaries of young people in the field. While Malaysia, with a score of 95 out of 100, topped the Best Healthcare in the World category of the 2019 International Living Annual Global Retirement Index, there was a “significant rise” in graduates from the health and welfare sector earning a low starting pay of less than RM2,000 #medicolegal #healthcare #mlsm

Ms Jayanthi Gamage was at work in August 2023 when an e-mail from the University of London arrived in her inbox. It included the word “Pass”, which marked the end of her seven-year journey to complete a law degree and a dream come true for the then domestic helper.Describing the 43-year-old Sri Lankan’s journey as a “long” one makes light of it. It spanned two countries thousands of kilometres apart, and saw her juggling her studies over several years while working as a domestic helper in Singapore. #mlsm
